Digital-4-U Terms and Conditions of Use and Sale
These Terms and Conditions apply to all
transactions on this site (www.digital-4-u.co.uk).
Please read them carefully. They do not affect your statutory rights.
We may change these terms and conditions at any
time. Any changes will take effect on the date they are posted onto the site
(see date above). You will be asked to read and accept the terms and conditions
each time you place an order, to ensure that you are familiar with the most
current ones.
Our
Contract
You will have an opportunity to check and correct
any input errors in your order up until you click the Confirm Order button.
After you confirmed an order we will give you an
Order Reference Number and details of the products you have ordered. We will
send the same details to you in an e-mail when we start to process your order.
Please note that these e-mails are acknowledgements, not acceptance of your
order.
Acceptance of your order and the creation of a
legally binding contract between us will only occur when we send you a second
e-mail, which confirmed that your order has been accepted. Alternatively, we may
decline all or part of your order for any reason, in which case our second
e-mail will tell you so.
When deciding whether or not to accept your order
we may use certain information about you, including any received from
Streamline/PayPal who are our card payment processing agency or other related
agencies.
If after acceptance of your order we discover
within 5 working days of such acceptance that all of the goods are unavailable,
we may terminate the contract and refund or re-credit you within 7 working days
for any sum that has been paid by you or debited from your credit card for those
goods. In these circumstances, we will inform you as soon as possible.
If within 5 working days of our acceptance of
your order we discover that some but not all of the goods are unavailable, we
will no longer supply those unavailable goods. In these circumstances we will
contact you detailing the goods that are unavailable and offer you the option of
cancelling the whole order or amending your order to substitute the unavailable
items with alternative goods. If you have not cancelled the order within 14 days
of receipt of such notice, we will deliver the available goods in accordance
with condition 4 below. We will refund or re-credit you for any sum that has
been paid by you or debited from your credit card in respect of the unavailable
goods or cancelled order (if you have cancelled it).
Every effort is made to ensure that prices shown
on this website are accurate at the time you place your order. If within 14 days
of receiving your order (but before the second email which confirm the
acceptance of your order) a pricing error is found in respect of any or all of
the goods you have ordered, we will notify you as soon as possible detailing the
mis-priced goods and offering you the option of:
1 placing a new order at the correct price for
those goods;
2 cancelling the whole of your order; or
3 cancelling your order for the mis-priced goods
and reconfirming your order for the correctly priced goods.
4 If, within 14 days of receipt of our notice to
you, you have not responded by selecting one of the available options at
conditions 1 to 3 above then:
(a) if all of the goods you have ordered are
found to be mis-priced, the entire order will be cancelled automatically and the
Supplier will refund or re-credit you for any sum you have paid for those goods;
or
(b) if only some of the goods you have ordered
are found to be mis-priced, our contract with you continues and we will deliver
the correctly priced goods but we will not be obliged to supply you with the mis-priced
goods. In these circumstances we will refund or re-credit you for any sum you
have paid for the mis-priced goods.
To avoid any doubt, where goods are unavailable
and you order alternative goods from us, or where goods have been mis-priced and
you subsequently order such goods at the correct price, these terms of sale
shall apply to the order and the supply of the relevant goods, whether the order
is placed through our website or otherwise.
Prices and
Payment
The total cost of your order will be the price of
the products you order plus the applicable delivery charge. All these will be
set out clearly in your Shopping Basket before you submit your order.
Prices, offers and products are subject to
availability and may change before (but not after) we accept your order. If
something becomes unavailable we may offer you an alternative.
We accept payment by PayPal, Credit/Debit Card,
BACS/CHAPS wired bank transfer or cheque.
We will tell you if your payment cannot be
accepted via PayPal or credit/debit card for any reason and may invite you to
pay by another method. Please note that products, prices and offers in our eBay
Store/Amazon Store may differ from those featured on this site.
VAT and
Duty
All prices and charges on this site are in UK pounds.
As trade agency, the goods we (Digital-4-U) sell
on this website will be dispatched from our business partners (including our
overseas business partners) directly.
Digital-4-U does not collect VAT from customers,
hereby, Digital-4-U won't be able to provide customers with an VAT receipt.
Instead, the standard non-VAT business invoice and receipt will be provided to
customers as proof of purchase.
The price listed on this website is the final price for customers to pay.
Customers within the following EU countries don’t
need to pay extra for VAT/Duty.
For those orders which were dispatched directly
from our overseas business partners outside EU, we will try our best to clear
the import VAT/Duty payment with our partners before the goods were dispatched,
however, it is still possible that some customers will received an VAT/Duty
invoice from local authority or related couriers. If that is the case, customers
have the following options:
Customers can
pay the payable VAT/Duty payment first and claim the VAT/Duty reimbursement from
us by filling the VAT/Duty reimbursement claim form which available on this
website after logging in to the customer's account on this website, we will
reimburse customers VAT/Duty cost within 1 working day.
If the
VAT/Duty invoice was issued by related courier, customers can contact us with
the courier's VAT/Duty invoice copy in email/fax, we will contact the related
couriers to clear those invoices for you.
Delivery
Your orders will be dispatched from our business
partners (either UK inland or overseas) directly.
Delivery must be to an address in UK or one of
the following European countries:
All deliveries must be signed for (except items
sent by post and which are small enough to be put through your letterbox).
Please make sure you keep the receipts which will accompany your order.
When payment was processed by PayPal or
credit/debit card, the delivery must be identical to your PayPal account
verified address or your credit/debit card registered address.
Delivery Charges
We are making every effort to keep our delivery
charges as low as possible. Our charge depends on the type of product ordered
and whether you choose the standard delivery (7 working days) or express
delivery service (3-4 working days). You will always be able to see all
applicable charges before submitting your order.
Delivery Times
Delivery times are calculated in working days -
i.e. Monday to Friday inclusive (but excluding Bank Holidays). If you order
after 3.00pm, please calculate your delivery time as if your order had been
placed the following working day. For next week day delivery (if available)
please order before 10:00am.
The delivery time will be displayed on the
checkout page before you confirming the order.
IMPORTANT: We do everything we can to meet the
delivery times specified in this section. However, occasionally delivery times
may be affected by factors beyond our control ( eg. problems obtaining
authorization for your payment ) and therefore they cannot be guaranteed. We
will inform you if we become aware of an unexpected delay.
We will notify you which delivery method we will
use when we send you our second e-mail. Very occasionally different products in
the same order may be delivered separately.
Tracking Your Order
You can track the progress of your order by
logging in and then going to ‘My Account’. We will inform you if there are
likely to be any unexpected delays.
Missing, Damaged or Incorrect Orders
We try very hard to ensure that you receive
your order in pristine condition. If you do not receive all your products,
please check that they have been dispatched by using our tracking facility
(simply log in and then go to ‘My Account’, ‘My Order History). If your order is
not en route to you, please e-mail us at

(0)845 388 6589. In the unlikely event that a product arrives damaged or faulty,
please contact us for replacement/refund.
Return and Refund
Change
of Mind Cancellations
You can cancel your purchase at any
time up to 7 working days starting the day after delivery by:

to request the product return approval reference number.

your order reference number and delivery details to hand.
* “working days” means all days other than
Saturdays, Sundays and Public Holidays
Your product must be complete and in 'as new'
condition e.g. if you have opened the box to examine the product you must have
done so without damaging or marking the product or packaging. It must not have
been used or installed. It should be returned with the original box, packing and
accessories you received with it. Any software must still be sealed. Any 'Free
Gifts' received with the product must also be returned.
If you follow the steps above you will receive a
full refund of the product price including the original postage you've paid
We cannot cancel your purchase when:
# there is a extra promotion connected with the
product, for example, manufacture cash back promotion and you have already
claimed for that extra.
# the seal has been broken on any software CDs,
or
# the goods were a special order to your
specification.
Whilst the goods are in your possession, you must
take reasonable care of them and not use them.
Faulty
Goods
The following are guidelines. Wherever possible
we will respond to your individual circumstances.
You will always have the option of an exchange or
refund if the fault occurs within 7 working days of delivery. In all cases we
reserve the right to inspect the product and verify the fault.
To qualify for a refund or exchange the product
must be:
# in otherwise "as new" condition; and
# complete with any accessories and free gifts
offered with it and, if possible, the original box and packaging.
Please phone us on +44 (0)845 388 6589 (10am to
5pm Monday to Friday, closed on weekends) to request the collection of faulty
products from you.
This promise does not cover faults caused by
accident, neglect, misuse or normal wear and tear. For consumable items (e.g.
non-rechargeable batteries, camera films, ink cartridges etc) the guarantee
period is three months from delivery.
If a software is faulty under guarantee we will
happily exchange it for the same product or offer a refund.
Any refund due to a fault or other defect will
include a refund of the applicable delivery charge. We will also pay for our
costs of collecting goods for replacement or refund. Replacement goods are sent
by standard delivery only (i.e. premium services are not available).
Extended warranties which been ordered separately
or offered as extra gift are supplied by third party service provider such as
MACK camera service, please refer to the specific service provider's terms and
conditions to use their services.
These terms and conditions and all transactions
relating to this website are governed by English law and are subject to the
non-exclusive jurisdiction of the English courts. We do not accept amendments to
these terms and conditions.
Your data protection rights are set out in
our
Privacy Policy.
Items sold on this website are intended for
normal domestic and consumer use and are not intended for resale or commercial
use. We reserve the right to refuse access to this website, to remove or edit
content, or to refuse or cancel orders at our discretion. If we cancel an order,
it will be without charge to you, and we will reimburse any payment made by you.
